These Terms of Use govern the use of the mobile application "Levida" (hereinafter "App"), developed and provided by Alexander Köhn (hereinafter "Provider").

By downloading, installing, or using the App, you agree to these Terms of Use. If you do not agree with these terms, please do not use the App.

Levida does not require registration or a user account. All data is stored exclusively on your device. There is no sign-in via email, password, or social media accounts.

6. In-App Purchases and Subscriptions

Levida offers the following paid options:

Payment processing: All payments are processed exclusively through Apple's App Store. The Provider does not receive any payment information from you. The Apple Media Services Terms and Conditions apply.

Subscription renewal: Subscriptions renew automatically at the end of each billing period unless cancelled at least 24 hours before the end of the current period.

Cancellation: You may cancel your subscription at any time via your iPhone settings: Settings > [Your Name] > Subscriptions > Levida. After cancellation, you may continue to use premium features until the end of the paid period.

Refunds: Refunds are handled exclusively by Apple in accordance with App Store policies. For refund requests, please contact Apple Support directly.

7. Free Trial

A free 7-day trial is available for the monthly subscription. During the trial period, you have access to all premium features.

8. Intellectual Property

All rights in and to the App, including but not limited to software, design, text, graphics, logos, and trademarks, are the property of Alexander Köhn and are protected by copyright law.

IMPORTANT NOTICE: Please read this section carefully.

Levida is NOT a medical device. The App is not classified or approved as a medical device under the EU Medical Device Regulation (MDR, Regulation (EU) 2017/745) and is not subject to MDR regulation.

Levida does NOT replace medical advice. The App does not provide medical advice, diagnosis, or treatment. All information and features within the App serve exclusively for personal documentation and informational purposes.

Disclaimer: The Provider assumes no liability for any health-related harm resulting from the use of, or reliance on, information presented in the App. Use of the App is at your own risk and responsibility.

10. Limitation of Liability

The Provider shall be liable without limitation for intent and gross negligence, as well as under the provisions of the German Product Liability Act (Produkthaftungsgesetz). In cases of slight negligence, the Provider shall only be liable for breaches of material contractual obligations (cardinal obligations) whose fulfilment is essential for the proper performance of the contract. In such cases, liability shall be limited to the foreseeable, contract-typical damage.

Continued use of the App following the publication of amended Terms of Use constitutes acceptance of the changes. The current version is available at all times at https://levida.app/en/terms.html.

14. Severability

Should any provision of these Terms of Use be or become invalid, the validity of the remaining provisions shall not be affected. In place of the invalid provision, a valid provision shall be deemed agreed upon that most closely reflects the economic purpose of the invalid provision.

15. Governing Law and Jurisdiction

The laws of the Federal Republic of Germany shall apply, excluding the United Nations Convention on Contracts for the International Sale of Goods (UN CISG).

If you are a consumer, the mandatory consumer protection laws of the country in which you are habitually resident shall also apply insofar as they afford you greater protection.

The place of jurisdiction for all disputes arising out of or in connection with these Terms of Use shall, to the extent permitted by law, be the domicile of the Provider.

The European Commission provides an online dispute resolution (ODR) platform: https://ec.europa.eu/consumers/odr. We are neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration body.
